Olson Not a Good Choice for Attorney General

Publius has a couple of posts up over at Res Publica et Cetera about the prospect of President Bush nominating former Solicitor General Ted Olson to replace Alberto Gonzales as Attorney General.

This is what I added in comments at one of Publius' posts:
The fact that his wife [conservative commentator Barbara Olson] died at the hands of terrorists [in the plane that crashed into the Pentagon], in my mind, might make him not altogether as impartial as one perhaps should be as AG. It's almost, in essence, nominating the husband of the victim of a crime to investigate that crime (considering that the AG is a key component in fighting the same War on Terror that began with the act that murdered [Olson's] wife).
Please note that I'm NOT saying that crime victims cannot effectively serve in law enforcement capacities. That's NOT what I'm saying at all.

But we have to admit that this particular instance involves special (and delicate) circumstances.

I don't think that is a particularly relevant reason. As you know it is more of a political office. I just don't see much difference between his S.G. role and a potential AG role as far as conflict of interest goes. If he hadn't been SG, then I might think differently.

I think it's more of a problem with the "appearance" of a conflict than anything else.
