Ohio Judge Throws Out Rape Case After Prosecutor Late to Court

CLEVELAND (AP) — A Cuyahoga County judge threw out the charge against a man accused of raping a girl six years ago when the prosecutor in the case was 45 minutes late to trial.My Comments:

The mother of the now 16-year-old Rocky River girl said her daughter feels victimized by the judge’s decision.
Common Pleas Judge Eileen Gallagher dismissed the case when Assistant County Prosecutor Mark Schneider had not shown up by 1:45 p.m. Monday, after she told both sides to be in court at 1 p.m.
Schneider was in his office preparing an appeal seeking to prevent the judge from continuing with the trial.
Earlier in the day, Schneider had asked the judge to remove herself from the case, saying the judge said last year that she thought the accuser had credibility problems.
“Nobody should be rendering opinions from the bench before trial,” Schneider said. “A child victim who’s being put through the wringer deserves a fair shake at trial.”
Gallagher said her decision to throw out the charge had nothing to do with the girl’s credibility.
“It was all about the unprofessional actions of a prosecutor,” she said. “You don’t show up — too bad. Don’t treat me like a punk and not show up in court without giving us the courtesy of notifying us where you are.”

What the hell kind of judge talks that way? A real lady, that one.
Apparently has a thing for letting rapists off easy, too.

I did not realize that there are 2 judges by the name of Eileen Gallagher sitting on the Cuyahoga County Common Pleas Court. Unfortunately, I originally posted the photo of the wrong Judge Eileen Gallagher.
I have now deleted the photo, and apologize for any confusion caused by my originally posting the incorrect one.

so because the prosecutor "hurt her feelings" and "disrespected" her, she lets a child molester off scott free.

I am sorry but is this judge on a power trip. Who is she to say that little girl is unimportant. I am tired of the victim in the case getting treated worse than the defendant!!!!! What is wrong with this world!!!!! That little girl will continue to suffer knowing her rapist is out there still all because of a SELFISH JUDGE ON A POWER TRIP. I think the world would be a better place should Judge Gallagher be taken off the bench. Your Honor what a joke!

I try not to delete comments on this blog unless they completely cross the lines of decency.
I deleted the previous anonymous post because it advocated the kidnapping, rape, and murder of the children of a sitting judge.
That's about as bad as a comment can get. This is a blog that advocates on behalf of the teachings of the Catholic Church and on behalf of families. Such comments are antithetical to what this blog is about.
Any future comments of that sort will also be deleted.
This is the problem with Liberal pricks on the bench. As has been said before "what a douchebag!".
This Judge should be removed from her position. This is an outrage. She is letting her personal feelings let a monster go free. When he rapes again, or worse, a murder, and he will, it will be on her hands. She doesnt care about victims, only her own twisted hurt feelings. What a scumbag.
This woman is a travesty to the court system....If this man had alledgedly raped a nine year old in HER family I can guarantee this would not have happened....HOW SAD....

I believe we should throw all of these judges out and start over and make common sense a priority over intelligence (not that these people have any of that either)
